Chimney and specialty repair: the law before the cost

Before the cost of any chimney work, the law that sits on it. Under Ontario Regulation 213/07, the Fire Code, Article 2.6.1.4, every chimney, flue and flue pipe shall be inspected to identify any dangerous condition at intervals not greater than 12 months, when an appliance is added, and after any chimney fire, and shall be repaired or replaced to eliminate any structural deficiency or decay; Article 2.6.1.5 requires cleaning as often as necessary to keep it free of combustible deposits; and Division A, Article 1.2.1.1 puts the duty on the owner, with this section on the short list of Fire Code provisions that reach inside a private house. The most consequential number in chimney masonry is a clearance: Building Code Article 9.21.5.1 requires not less than 50 mm between an interior masonry chimney and combustible framing, 12 mm for an exterior chimney, 150 mm between a cleanout opening and combustible material, and 12 mm from combustible flooring and ceiling finishes, with every such space sealed top or bottom with noncombustible material. Fifty millimetres is under two inches; a rebuild, a liner replacement, or framing repair that closes that gap is a fire hazard, and the province licenses nobody to do this work.

A masonry fireplace triggers a carbon monoxide alarm requirement in law, wider since January 1, 2026: Fire Code Article 2.16.2.1 requires an alarm adjacent to each sleeping area and on each storey without one wherever a fireplace, flue or fuel-burning appliance is installed, and the obligation attaches to the fireplace itself, not to whether anyone still burns anything in it.

Why the mortar type affects the price

Lime-dominant mortar mixes cost more in materials and require more care in application, with a longer working time and more controlled curing, than a standard Portland mix. On pre-1960 soft brick, using the wrong mix is not a savings: hard Portland mortar damages the brick face over successive freeze-thaw cycles, and that damage is irreversible.
