Terms of Service

These terms govern the Living Websites service: the packages described on our packages page, ordered online or agreed on a call. Living Websites is a registered Ontario business operated by Bryan Benner ("we", "us"). We have tried to write these terms the way we write everything else: plainly, without surprises.

The service

A Living Website package has two parts. The setup is a one-time build: a complete website for your business, live on your domain. The subscription keeps the engine running: our system publishes genuinely useful pages about your business on an ongoing cadence, and we handle hosting, TLS, maintenance, and monthly reporting. The scope of each package is written on its page at the time you order, and that written scope is part of these terms.

Every page our engine publishes must pass our honesty gates before it goes live: content must be genuinely useful and must not state fabricated facts. You can review any published page and request changes at any time, and we will make them.

Billing and taxes

The setup fee is billed once, when you order. The subscription is billed monthly, in Canadian dollars, through our payment processor Stripe. Prices are listed on the packages page.

We are not currently registered for GST/HST (we operate as a small supplier under Canadian tax rules), so no tax is added to invoices. If our registration status changes, tax will be itemized on invoices from that point on and your total will change accordingly; we will tell you before that happens.

Term and cancellation

The subscription is month to month. There is no minimum term and no cancellation fee.

You can cancel at any time by emailing hello@livingwebsites.ca. Cancellation takes effect at the end of your current billing period: you keep the service until the period you have paid for runs out, and you are not billed again. Amounts already billed for the current period are not refunded.

The setup fee is refundable in full if you cancel before build work begins. Once build work has begun, the setup fee is not refundable.

We can end the service with 30 days' written notice. If we do, we refund any amounts you have prepaid past the end of service.

What you own

You own your domain name, and you own the content of your website, including the pages our engine writes for it. This is the point of the service: the website is your asset, not ours.

If you cancel, we hand you the site as it stands: a complete copy of your website's pages and files, portable to any standard host. The engine stops publishing new pages and our hosting ends at the close of your final billing period, but everything published up to that point is yours to keep and host anywhere.

The engine itself, the software and systems that generate and maintain the content, remains ours.

What we promise, and what we do not

We promise the mechanics: the site stays live, pages are published on an ongoing cadence through our honesty gates, and you get a plain monthly report of what happened.

We do not guarantee search rankings, traffic volumes, or lead counts. Search engines and AI assistants are third parties we do not control. What we publish is designed to earn visibility honestly, and our own site is the public evidence of the approach, but no honest provider can promise a specific position or number.

Your responsibilities

You agree to give us accurate information about your business: your services, your credentials, your contact details. The engine writes from what is true about your business, so what you tell us has to be true.

The service is for lawful businesses. If your profession is regulated, you keep responsibility for your own regulatory compliance; we write content to respect your regulator's rules, and anything in advice territory waits for your sign-off, as described on the packages page.

Liability

Our total liability to you for any claim arising from the service is limited to the amounts you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential losses, such as lost profits or lost business opportunities. Nothing in these terms limits liability that cannot be limited under applicable law.

Changes to these terms

We may update these terms from time to time. If we make a material change, we will email active subscribers before the change takes effect, and the effective date at the top of this page will be updated. Continuing to use the service after a change takes effect means you accept the updated terms; if you do not, you can cancel as described above.

Governing law and contact

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
